Fortune Minerals Limited is a mining company. It is engaged in the exploration and development of mineral properties in Canada. It is focused on developing the NICO Cobalt-Gold-Bismuth-Copper Project in the Northwest Territories and Alberta that produces a bulk concentrate for shipment to a refinery that it plans to construct in southern Canada. It has a 1% net smelter royalty covering 78 hectares of land positioned in a former silver mining district, located south of the Eldorado mining district at Great Bear Lake.

The thing with the supreme court, nothing is "grandfathered". We have to be really mindful with rulings that occur from the supreme court because it allows other indigenous nations to reopen disputed issues. Especially, if it was determined that the decisions of the past were wrong. 

Not that i personally see a reason for it to matter right now in this case but for future cases with other indigenous groups that take their claims to the supreme court, it is important to recognize the case law implications it can have on canada. 

If anything, the supreme court is the "grandfathered buster" in most situations
