Saw this article on the ceo board.
Despite attempts to bring "the small island" law to the forefront in asking the courts and ministry to prevent Baru from mining, this article from the Constitutional Court of the Republic of Indonesia says in numerous places throughout the article the following: 

"the Management of Coastal Zones and Small Islands still allows for mining activities as long as all statutory regulations aimed at preserving the environment of small islands are still"
 

thus what else is there other than just continuous lawsuit attempts. This already says mining is possible on small islands. Enough said. Rest is just noise.
