Subject: Sage Ranch - Tehachapi Loop

Hello Pat ...

We are demanding an immediate retraction to your false claims about Sage Ranch that you published the Tehachapi Loop on Nov. 25, 2023.

Your post is both defamatory, false and biased.

I have copied our legal counsel, Carissa Beecham.

We will sue you personally and the newspaper if these false claims are not removed immediately. You specifically made the following quote:
"Although Commissioner Nixon stated that, in her opinion, the Sage Ranch project was "too big for Tehachapi," the Commission voted 3-0 to approve the Phase 1 Precise Development Plan for Sage Ranch. In the absence of Commissioners Charles White and Linda Hollingsworth, approval was given by Commissioners Kim Nixon, Daryl Christensen and Steve Hamblin. It must also be noted that no development can begin until all legal challenges have been decided."

You do not reference who/where this highlighted comment above was addressed in the meeting but you have directly referenced it in the article.

This highlighted comment above is not true and this is not what was said at the meeting. I was there. There is no cloud on title.

Our litigation against Stuart Nacht, nor the water district's litigation against the city does not stop the project and it does not cloud the title.

Our litigation against a former consultant, Stuart Nacht, does not and will not cloud the title and neither does the water districts litigation.

There is no cloud on title and a judge will not issue a cloud on title as per the Water District litigation against the City, nor our $1 million lawsuit against Stuart Nacht.

Please retract immediately or we will take legal action. You are falsely defaming our project.

If you do not remove the Line: It must also be noted that no development can begin until all legal challenges have been decided." we will obtain a court order forcing you to remove that line and you will pay our legal costs.

Claudia Elliott has removed her false claim saying the same thing in the digital version of the Tehachapi News after we contacted her via email with our lawyers.

Just because you or your owner Claudia do not like the project, you have no business making false statements and defaming the project.

Govern yourself accordingly
