The legislation defines that, for the demarcation of indigenous lands, there must be proof that the original peoples occupied that area on the date of publication of the Federal Constitution, in October 1988. The text contradicts the September decision of the Federal Supreme Court (STF), who understood that the thesis is unconstitutional. The vetoes imposed on the bill in October by President Luiz Incio Lula da Silva (PT) were overturned by Congress on the 14th.
