BOOM: CAN BAYTEX PURCHASE JUNIPER SHARES??

BOOM: CAN BAYTEX PURCHASE JUNIPER SHARES?? From Baytex through Red:

More fresh details about it from Brian Ector itself :

Questions : Can Baytex buy back the shares of Juniper, with this agreement ? If so, could it be considered in whole or in part through the actual NCIB ?

Juniper owns ~ 12% of our shares outstanding today. With Juniper over 10% they are deemed an insider and we are not allowed to repurchase shares directly from an insider. If and when their ownership falls below 10%, we would be allowed to purchase shares directly from Juniper and would consider this in the context of our NCIB program and free cash flow profile.
