The judge noted that the water rights in question were not in possession of Greenbriar prior to completion of the EIR and put forth the question, what if the developer decides not to move forward with a pledge of 175 acre-feet of water rights?
the city argues that the first permits will not be granted until the transfer of water rights takes place.
The judge is finding facts, just cause the water district thinks it's not feasible doesn't mean that is correct. The city believes they are correct so it truly comes down to the judges decision.
