RE:How Heavy is the Return The Chilean court system has no prequalification for any lawsuit.  So, neither standing, jurisdiction, nor the statute of limitations is considered when a lawsuit is filed.  Those questions are left to be determined during the trial.  For example:  In C 22637-2015, the Protocol trial against Fisco de Chile, the verdict determined that JL had no standing, the statute of limitations had expired, and the grounds on which he was suing were inappropriate.  Nevertheless, the trial took three years to make that finding.  It also took three years for the Court to determine that Chile had no jurisdiction over the BCSC in the libel trial.
 
As a result, the Chilean courts are overwhelmed with suits with little or no prospect of success. The courts will simply rubberstamp many requests just to get the requests out of their inbox regardless of their merits.
