VG (company) will walk you can bet on that unless

VG (company) will walk you can bet on that unlessIf VG mgmt doesn't want to "play" and there is no wrongdoing by them, they walk.

EoM.

Canadian law is set up that way, ONLY the company is liable, not managment unless there is wrong doing.  OK

If there is no more money to pay anyone  for lack of revenue to proceed that's it.

That goes all the way down the line of any company involved..  If engineers are proven to delberately have provided wrong doing  (not likely) insurance (society) kicks in.

https://ospe.on.ca/membership/understanding-professional-liability-for-engineers/

Simple case, OK it's stupid but...

Mine manager - I've been told  we need more gold by JM (JM was told by ENG it's OK we ran the number's just load er up) and tells staff
Emps - We've been told to get too it. Just throw more ore around, increase emiter flow, run those cats hard.
HLP collapes, mine goes into receivership.  Money burned.
YTG immediatley secures it - that's reality

Goes to Court

Judge - JM did you tell mine manger (MM) to increase the "loading"
Jm - Yes I was told by ENG just do It.
Judge - OK Your off the hook
Judge - Where's the MM
MM - I'm just doing as instructed.
Judge - Your off the hook
Judge - Where's that ENG
Eng - Your honor?
Judge  - Did you instruct JM to just do it
Eng - Engineering ran the numbers, its kool.
Judge - Really?
Eng - Yes, our co and associate co's all ran the numbers they're good, maybe our "slide rules" are sht (first seed of doubt of some other issue)
Judge - Get me 3rd party ENG
3rd party ENG - Yes your honor, we collaborated and yes your honor the numbers are good.
Judge - Thank you for your time.
Judge - This is getting way to stupid.  It's a bad "act of god", just fix the stupid thing and get on with it.

Of course it is way more complicated (lol) but unless anyone can prove there was a deliberate attempt of wrong doing, it's going nowhere as VG and other co's not liable.

The end senario in all likely hood of all the mgmt team and the professional(s)  involved paying for this are 0.

It's like your internet provider, your on line making the big trade, fiber goes down, you lose a billion dollar trade.  You go to sue provider.  The first thing they will do show you the "best efforts clause". End of line for you.

In real life this doesn't happen as the electonic trade is in a "double commit" scenario
I won't get into that., I know your all saying GREAT. :)

For those of you that say where is JM  (maybe hiding or flown away) and people say he's not available.

I'll leave you with this true story.

"Al Kulan, had been killed in a bar in Ross River Yukon with a single shot from a .357 revolver. He had been killed by his old friend John ‘Jack’ Rolls, my client"

https://www.kelownanow.com/watercooler/news/news/Tony_Peyton/Death_in_the_Yukon#fs_138970

Like I said The Yukon is "Larger than life"   If you were in the bar in Ross River you would understand.

The Yukon "Larger than LIfe"  ;)
