PsychoEven though the Court ruled that a pysch evaluation of JL in C 29407-2016 was inappropriate, the plaintiff's submitted one anyway. The evaluation was prepared by the same psychologist that submitted the psych report for C 1036-2021. I didn't bother to translate the entire report, however the translation of the Conclusion is below:
"Faced with the evaluation process of Mr. Jorge Lopehanda, we recognize indicators of severe alterations in his state of mind, which, from what has been investigated, have their origin in the judicial litigation under investigation, where the evaluated shows an overload in the face of the need to expose his truth and – from his point of view – clear his name. since he recognizes a loss of income towards himself, which has interfered with his ability to develop personally and professionally.
At the neuropsychological level, no alterations in the psychic functions linked to the sense and judgment of reality are identified, there is a perception and personal representation and the environment discussed, with inductive and deductive logical thinking, which maintains an ideo-affective agreement, which allowed the subject to be perceived on repeated occasions emotionally affected by the events reported.
In addition to the above, a personality is identified in the neurotic line, where there is determination, planning, organization and perseverance in the face of his interests and requirements, but also rigidity and obstinacy. The latter has meant that the subject, for a long period of time, has been involved in legal litigation, due to his interest in demonstrating his personal truth.
In this scenario, it is also recognized that the person being evaluated is emotionally and physically exhausted, since, through his report and the results of the tests applied, indicators of emotional alterations are perceived that may investigate a possible depressive condition, but that must be confirmed or ruled out by a psychiatrist."
Most likely, this will be deemed inadmissible.
