Even Eric Sprott has said today that "If the Transaction does not proceed and/or the support and voting agreement is terminated, Mr. Sprott may acquire additional securities of American Creek including on the open market or through private acquisitions or sell the securities including on the open market or through private dispositions in the future depending on market conditions, reformulation of plans and/or other relevant factors."
So taday its a cash transaction as previously stated but it isn't quite written in stone as of yet with the trapdoor out still in effect.
