Here's an example:
First Nation sues Yukon government over mining approval - Yukon News (yukon-news.com) The YTG has a duty to consult and involve FNs in their decisions or risk getting sued. I suspect that if FNs hires its own engineers to conduct their own independent investigation into the Eagle slide and finds any evidence that the YTG didn't adequately consult with them during the Eagle mine review and approval process, and later with regard to events leading up to the slide event and since then failed to protect FN's interests, they won't hesitate to sue the YTG. I also suspect that YTG's swift application to the courts to place VG into receivership was driven by YTG's need to attempt to avoid, or at least delay FNs filing of a major suit.
If FN's pursues it's own independent investigation into the Eagle slide and the investigation of the events leading up to the slide prove YTG negligence, FNs won't hesitate to sue the YTG. FN's has been after YTG for years to consult with them on their traditional territory land use and will probably attempt to use the Eagle slide event as evidence of the result of YTG's failure to consult.
The fact that there is only a couple of lawsuits filed against VG so far is probably more because lawyers are also waiting for the results of the independent investigation(s) by expert engineers as we all are. These investigative results will be key to aligning civil liability with the appropriate entity and that's when the real lawsuits will be filed. Currently, there's still too many unknowns for lwayers to decide how to proceed. If YTG can escape this without a lawsuit being filed against them by FNs or the Common shareholders (again depending on the independent engineers investigative results), I'll be surprised. YTG being a government entity has public coffers far deeper than a VG in receivership and is therefore a more viable target for being sued for millions if not billions because suing VG won't get much (stand in line to get pennies on the dollar). If YTG is proven negligent in any aspect of its responsibilities as the Governing Authority for Yukon Mining you can bet the lawyers won't hesitate to act accordingly. As the old saying goes...Follow the Money!
