You would think there would have been some foresight to include a break fee, considering the estimated costs to complete the scheme offer.
On page 103 Section 11.1 there are estimated fees expected to be incurred with the scheme offer for both parties ... Touchstone EU 1,747,478, and Trinity EU 2,646,590 .... wouldn't be unreasonable to expect those expenses to increase for both parties now with the Lease Operators counter offer.
I think that Touchstone attends the court meeting next week and files a motion, probably something like a motion to maintain the current end date of January 31 2025 ... if Touchstone doesn't show up at the court meeting, it would probably imply that Touchstone plans to walk away from the deal .....??
