As I understand it, and I am not a lawyer, TUD is free to explore from surface every square inch of TC. If TUD is able to produce a definitive mine plan with an Environmental Assessment Cerificate, SEA will have to move the MTT if it interferes with those mine plans.

If the MTT has already gone through those mine plans, all the mineralized material must be stockpiled by SEA for TUD. Thatt's gold production for TUD without having to mine. Free ore. And the best possible confirmation of TUD's deposit.

It seems to me TUD has not lost a thing.
