I think the proper context is that some Facts may contribute to some level of Uncertainty or Doubt.

But unfavourable or challenging Facts are not permitted by the promoter pump group when speaking of HPQ and PYR.

Of course, this is my fair and reasonable assessment and is waaay over pumpers' heads. Nor do they care, these criteria are not within their job description.
