I think that Trump put in the 2016 negotiated USMCA, a condition that, if there was an EMERGENCY at their US border, during the duration of the USMC Agreement (2026), then they could close their borders, or put on Tarrifs. I haven't read the USMCA, but I bet there is a similar condition in the Agreement. That's why you have to have smart people negotiating for you. Bombardier made that mistake with Airbus. Now I see Canada did it with the USMCA. You need good Lawyers. I can almost guarantee, what I just said about the condition to change the USMC Agreement, is true. Otherwise Canada could sue the USA for BREACHING the USMCA contract in that Term. Trump is smart, and RE is his game. So contracts are his forte.

Secondly . If they or Trump uses the EMERGENCY part of the USMCA? He doesn't have to postpone the Tarrifs till it's the 2026 expiry. If I'm wrong, then Canada would have a recourse to go after the USA under the USMCA contract for BREACH of contract. Since nothing has been said about this breach of contract by Canada regarding the Tarrifs, then that just confirms my point that, the US has a way out of the contract. I hope that answers a few of your questions.

  1. Maybe I'm making a mistake but I believe that considering that the USMCA is due to be renegotiated in 2026, Canada and the USA will agree to move forward these negotiations. Why not agree to postpone these prices to a later date only if the new negotiation fails. This way, Donald saves face and Canada avoids tariffs. I would not be surprised if we were informed that this new approach is already on the table WW2

859, we sort of discussed this a few days ago on the board, and while I am not a lawyer, its very difficult to get financial damages for breaches of the USMCA for example.  If he puts tariffs on Canada on Feb 1, that is a direct violation of USMCA so I would think we should be able to sue for financial damages.  If the US isn't liabile for Trillions in damages, then he has nothing to lose

The reality is with 75-80% of our exports are destined for the USA, and 17.3% of US exports come to Canada.  We simply have a lot more to lose than the US and Trump knows that.  Plus you have people like Smith in Alberta going against Team Canada and cozing up to Trump.  He sees that, and in business that is a prime example of divide and conquer.

Trump today claim Canada killed 300,000 people because of the fentanyl coming thru our border (yes its beyond stupid funny).  43 lbs was caught heading from Canada and 19,600 lbs from Mexico.  I am completely lost, isn't it the job of the destination country to protect its borders?  I can't see how you can stop a Canadian on this side of the border walking along the Canadian side with a backpack for example, they haven't committed a crime, just like you can't stop me for walking down the street in say Toronto for no reason
