OSTE is running scared...just one guy's opinion,
more gratuitous propaganda by osteotech. what on earth would they have to gain by airing dirty laundry in public right smack in the middle of a trial?? (other than allowing jurors to find out about the patent while surfing the web last night). Stupid, stupid, stupid. Sounds like the reaction of a desperate bunch to me...and i hope our boys don't stoop to that level.
the patent was issued on the 30th, and the trial got under way the next morning. i'm kind of betting that gensci's legal team, at it for three years, didn't hinge their entire defense on a patent they found out about 12 hours ahead of time.
besides, the case isn't about gensci's patents, it's about gensci alledgedly infringing on OSTE's patents. Nothing's changed.
"The good guys" are still going to try and have OSTE's patents declared invalid, and to defend their own position using the reverse doctrine of equivalents.
as far as i'm concerned, this is a non issue. if i can pick up more stock at $.25 as a result of this, thanks, OSTE!
