Blanchard Lawsuit V BarrickI received a response from Barrick today. As indicated in an earlier post from me(response from Bill) Barrick did not appeal the judges latest decision. They did however ask for reconsideration for a portion of the order.

I have a few questions for you with regards to a News item which was released (not from Barrick) on 8 September 2003, "( Court Order in the case of Blanchard and Company vs. Barrick Gold Corp., J.P. Morgan Chase)"
HOT OFF THE PRESS:
Word to me is the Federal judge in New Orleans threw out JP Morgan and Barrick Gold's motion to dismiss in the Blanchard Coin lawsuit concerning gold price manipulation. It means the case is going to discovery and Morgan and Barrick will have to answer questions under oath about (possible) gold price-fixing. (This previous paragraph I found on a BB slightly modified).
My questions.
1. Did the Federal Judge throw out Barrick's motion to dismiss the above?
The judge granted some of Barrick's motions and denied others.
If yes, I see on your website under the heading "Motions to dismiss Blanchard litigation" 3 links to memorandums.
2. Was there a response (or News Release) from Barrick to advise all of us shareholders on this continuing litigation? Will there be an update to your website?
Barrick issued a press release when the Blanchard action was first announced. It periodically provides public updates of certain litigation matters (including the Blanchard matter) in the notes to Barrick's quarterly financial statements. Barrick third quarter results will be available after the market closes on Oct. 27.
I thought that I read somewhere that Barrick had 12 days after the ruling to appeal the judges decision to the 5th district appeals(?) court. (I can't find the source of this line again).
3. Would this be correct? If yes, did Barrick appeal? Was there a NR?
Barrick did not appeal the Judge's order -- it sought reconsideration of a portion of the order. It's request for reconsideration is pending.

Q. Anyone have an idea how long it should take the judge to deny Barricks latest request? (Just wishful thinking on my part).
