RE: Logical MoveI don't see how the Radiata 'litigation' can serve as case law in the Cisco situation. The case against Radiata was dismissed for failure of Wilan to produce evidence that Radiata was contravening their patent rights within Canada. As such no litigation was necessary to determine whether Wilan's patent was infringed or not in Canada. Just because Radiata claimed that no product infringing Wilan's patent was being sold in Canada at the time, it cannot be construed as an admission that the product, had it been sold in Canada at the time, would have violated Wilan's patent.
Having said all of this, I believe Wilan is right in pursuing Cisco now. This action is for shareholders benefit of which I am one. Have been on and off since it started trading on the Alberta Stock Exchange!
