RE: TWU's inability to responsibly bargain.Welcome to Stockhouse. Just finished reading your first post and I think YOU sould follow some of your own advise. Number 4 for instance: 4)Contracting out - I think someone should read before they rant. (though I am NOT commenting on the contracting out part I am refering to the "I think someone should read before they rant." As for number 5 this being called a strike by CIRB please read the finding. It is located at https://www.cirb-ccri.gc.ca/whatsnew/LD1291_e.pdf Page 6-12 I believe it deals with the term "LOCKOUT" not strike. I have cut and pasted the relevant parts but please take your time to read it. It is only 27 pages long aand it has a Conclusion. LOCKOUT STUFF (Page 6) On April 18, 2005, TELUS served the TWU with a Notice of Lockout effective as of April 25, 2005. (on page 10 -12) A - Does the failure to bargain in good faith negate the acquisition of the right to strike or lockout? According to the TWU a violation of section 50(a), automatically means that the breaching party has not met part of the requirements set out in section 89(1) of the Code, in particular subsection (b)(ii) which states that “no employer shall declare a lockout... unless the employer and -11- the union... have bargained collectively in accordance with section 50 but have failed to enter into a revised collective agreement.” (emphasis added) For the above reasons, the Board cannot accept the argument but forth by the TWU to the effect that a finding of failure to bargain in good faith by TELUS in violation of section 50(a), results in an illegal lockout for failure to meet the requirements of section 89(1) of the Code. Might as well post the Conclusion V - Conclusion For the reasons stated earlier, the Board declares that TELUS has interfered with the TWU’s representation rights contrary to section 94(1) and has failed to bargain in good faith and to make every reasonable effort to enter into a collective agreement, contrary to section 50(a) of the Code. Now having said all that Does not TELUS get imposed any penalties for failure to provide service if they issue a "LOCKOUT". Also as a customer and stockholder this concerns me greatly. One last point, with all the money TELUS is making why cannot they get rid of the long distance admin fee or lower it? To wrap up miri888 crawl back under the rock you came from, you are miss in forming the public to further your own needs, those needs being NOT as a shareholder but as a company lacky. You give new meaning to that corn found in the bowl of a toliet.
