Where is the cash going?

Where is the cash going?The company raises $13M, nets $8.5M after paying off all of the jokers involved in the OTC version, uses millions more for operations that are losing money hand over fist despite increasing sales and probably has cash to last another 1yr or just over. how is this not a scam?
