Rights of Mineral Rights

Bayfield has patented mineral rights for their properties in the Rainy River area. Does anyone know if that would prevent New Gold from being able to use the surface of burns block in their mininig operations? Is there a required set back on the boarder of mineral claims that would force New gold adjust there mining operations? Can Bayfields position here prevent New Gold from being able to get the necessary permits to build and operate a mine?
