Here is a very interesting analysis on the arbitration. If you read down about 4-5 paragraphs it states that due to environmental aspects Canada agreed with Colombia that EOM WAS NOT entitled to compensation.

Fortunately the arbitration board overruled Canada's position. That is scary, but read it for yourselves.
