ICSID enforcement

Not sure what the concern is with ICSID enforcement. ICSID does not enforce arbitration decisions. About 75% of arbitration awards are immediately paid up by the offending country. Not paying damages the countries ipinternational reputation for not complying with the international agreement. If countries do not pay the arbitration award can be collected from Colombian assets in any country that has signed on to the ICSID convention. Hopefully we do not need to go that route which will take a very long time to collect anything.

So frustrated by the timline on our little mess here.  Who can we poke to wake them up?  I have emailed icsid, the arbritrators and the president of our case ARB/16/41.  Nothing back.

But for the ICSID we are a third party, sadly. To get access as a third party to the ICSID the bar is very high. Formely the above link may have some informaton about it. But my feelng is ...more

What I called in my posting a "third party" is in language of the ICSID "a non-disputing party". When I looked into the ICSID rules I found also this one: Rule 38 Closure of the Proceeding (1) When the presentation of the case by the parties is completed, the proceeding shall be declared closed. (2) Exceptionally, the Tribunal may, before the award has been rendered ...more
