Because I think new lawsuits have taken place in the last two years that have made the law more clear. https://www.aicanada.ca/article/compensation-in-constructive-de-facto-expropriation-ignoring-the-scheme/. This is why we didn't go to court sooner. The law seems to be clearly on our side now within the last few years through court cases has made it more clear
