Oct 26th Deadline & can we sue for our investments.

Why cant Hitchcliff and the Directors and previous Directors put up the funds before Oct 26th? They have taken all the funds shareholders have given them, some at very high stock prices, and basically stole from their shareholders. Now is the time to put that money into the company so sharholders are not left with zero funds after investing very large dollar amounts into this company. If they dont raise the funds by Oct 26th, can the shareholders band together and sue Hitchcliff and the Directors?
