March 16th:
 
"In December, we raised $9 million, which brought our December 31 cash to $21.2 million. This cash takes us into the second half of 2023 and will allow us to see through the completion of the Stage 1 VITALIZE data and an early read of how the data is trending from the Stage 1 of the AVALON study."

"The real timing of that, though, is going to be a little bit of how it lines up with the schedule of conferences. I think it’s reasonable to say though, Joe, and I’m happy to have Jeremy opine on this, that the early look element of the data is not going to be it. We will show the full cohort. And remember, the first scan is the first scan. What we’re really wanting to see in the VITALIZE study is that durability of response which we showed with responders that were confirmed and complete across two scans."

Don't think it is covered by this. They said they had the money to the moment they could see data. March 16th too. Combined with this. March 16th too: "We are targeting a full disclosure of the data in the third quarter. We have enough data in hand to be confident about the direction that, that’s pointing."

This case stated that a statement can contain forward-looking and not forward-looking elements (as perhaps this case, but here the forward-looking statement relies on a historical fact, ie, they already have the money to reach the second semester), they are severable: https://www.labaton.com/cases/mf-global

I anticipate a case will be made - and like VXRT, I expect we will end up with a letter in the mail from a law firm.  But if they are bankrupt... is there anything left?
