Class Action Certification Hearing Jan. 15, 2024

This should be the next big hurdle for Sienna and other senior living, long term care operators.

The Ontario Government has appealed the class action certification filed against them early this year, but no news on that yet.  Because of this, there's a good chance this class action will get certification as well.

I think the lawsuit is frivolous, but it's happening, and I'm not sure the effect it may or may not have on share price.  Aside from this, Sienna fundamentals are strong.  If all goes well next month, Sienna will have a weight lifted, but if it gets certified, it may have a short term affect on share price.

The Ontario  government passed Bill 218 in December 2020 that provided immunity from Covid lawsuits. the standard to still sue would require GROSS NEGLIGENCE which would be very difficult to prove given the uncertainty at the time and the lack of clear direction from the govt on Covid policy.  This bill was also required to ensure LTC homes could remain insured.  British Columbia ...more

Very true, and that is what I hope will happen if this goes to trial. Unfortunately, it hasn't stopped the Class Action from getting Certified this past Jan/Feb 2023 against the Ontario Government who are now appealing the Certification. This is after Bill 218 was passed in 2020. I agree with you, this should not go anywhere, but the problem is, it's moving forward as Certificatin means ...more
