Did they ever officially state "ongoing concern"?  I kept my eye for that exact phrase but they failed to say it in the last 2 or 3 financial updates.  The closest thing said was "Company may not be able to continue to carry on business in the ordinary course." IIRC you must say legally state "ongoing concern" if bankruptcy is on the table.

no.  & If financing falls through, they'll prolly go for creditor protection then begin the sale process, not bankruptcy.
