What does this change ...

WHAT does this change regarding the auction of titles?
Comment by juanPeru on Nov 06, 2020 1:26pm
It does not change nothing regarding the auctions. It just shows the progress being made in the judicial process. The only way the auctions are cancelled/suspended is if the judge orders such thing as part of the second Medida Cautelar (for the 15 concessions without it), but I'm not sure if the 111 applicants would just be fine with that...

Juan, please indicate your legal experience. Are you a lawyer? The area was open for application. The auctions are divided into 100 hectare blocks and will be conduct on the same day. Its a mess and all cause by PLU's poor management.

Am I applying for a job in a legal firm? lol John, more seriously, you have to know this is a bullboard. In other words, this is a website we use to share information about the companies we're invested/interested in, not to share or ask for personal information. And yes, it is true that the area was open for application, but it is also true that the auction's winner won't be able to ...more

" it is also true that the auction's winner won't be able to obtain legal title on said area ". You don't know that. So if you are a lawyer, please the refer to a case that this happen. I will check your info if true or not with an actual Peruvian lawyer. These remates will happen probably within a year. So go ahead make my day!

Beware that obtaining title to the area (if you win the auction) is not the same as obtaining clean title (which i mentioned as "legal title", certainly not the right translation), that is, the kind of title that allows you to develop the resources you find in the area, without having to go through a long (and expensive) judicial process. Make sure to ask your lawyer about that ...more

If title is granted it will be clean. Again you are talking like a lawyer giving a legal opinion. So everyone be cautious with  juanPeru comments and oipinions. There will be multiple lawsuits if title is taken away. Please provide a case that a title was taken away.

I'm just giving you information/ideas so you can ask the right questions to your lawyer, hoping also that you will share his response with us... so don't shoot the messenger!!

I have reviewed your posts with people who know the Peruvian process. If title is granted it will be clear. PLU can sue the government for damages but will probably not have the property returned. This could take 10 years. You still haven't answered the question if you are a lawyer. Posting like this would be extremely unprofessional. We could meet in Miraflores to discuss this matter. I am in ...more

John, the source of my statements (which bother you so much) is the following paragraph of the last PLU corporate update: "The Company has filed notices with INGEMMET for inclusion in the dossiers of the nine concessions highlighting that there is an ongoing judicial case and an active administrative procedure and any interested party will not be able to obtain clean title on the area of ...more

That is a statement from the company. The same company that said the concessions were in good standing. In fact there are up to 18 applications on individual 100 hectare blocks. The main area will comprise of ten's of remates. Once title is granted it will be clean. You are the one who needs to provide a similar case. Where is the company's disclosure. Did their employees claim these areas ...more

Are you saying that the company has lied to its shareholders? You can't make such a serious accusation without adequatelly substantiating it. I'm sorry but if you don't provide strong arguments or reference to the non-anonymous legal opinion on which you are basing your accusation, I'll have to assume you are a paid troll and will treat you like that. What do I make with trolls ...more

The Company said March 15, 2019: "Plateau Energy Metals Inc. has been made aware that information was published by a third party late yesterday surrounding certain concessions in its 93,000-hectare land package being not in good standing. The company wishes to confirm all of its mineral concessions are in good standing and are 100 per cent controlled. The company regularly confirms that ...more

Not true. I have been following the concessions issue since then and I can assure you that, until August 2019, the 32 concessions (now expired) were in good standing (vigentes), which was easy to check on Ingemmet's database. So PLU said the truth. Regarding Ingemmet's resolution issued in February 2019, it's true it showed their decision to declare the expiration of the 32 ...more
