In summary: Ingemmet keeps appealing the first Medida Cautelar granted by judge Hermoza Castro for the group of 17 concessions.
Quick recap of the first precautionary process:
11/20/2019: Judge Hermoza Castro issued Resolution Number 2 (1) granting the first Medida Cautelar.
12/09/2019: Ingemmet presented an opposition against the Medida Cautelar. An opposition is an appeal that has to be resolved by the same judge that issued the disputed Medida Cautelar.
12/10/2019: Minem presented an opposition against the Medida Cautelar.
12/16/2019: Ingemmet executed the Medida Cautelar. Any Medida Cautelar has to be executed within the term granted by the judge, regardless of any appeal presented against it.
10/26/2020: After the long lockdown, Judge Hermoza Castro issued Resolution Number 5 (2), declaring unfounded the oppositions presented by Ingemmet and Minem, and thus conffirming the Medida Cautelar.
10/30/2020: Ingemmet presented an appeal against Resolution Number 5. Being in this case a regular appeal, it has to be resolved by a superior judge.
01/22/2021: Judge Hermoza Castro issued Resolution Number 6 (3) conceding the requested appeal, starting the process to open the corresponding file and raising it to the next superior judge in the judicial hierarchy.
How much time will this appeal take? I estimate 6 months, but could well be more than that, as the process of raising the appeal, finding an available judge and waiting for his/her response takes a lot of time.
