The judge will alow Trellus to proceed with claims.

Full docket text for document 331: ORDER: In terms of claims, the Court will allow Trellus to assert claims against all parties, although whether some or all of those claims will survive a pleadings motion is a question for another day, after full briefing. The Court will not allow wide-reaching discovery. Any additional discovery, which will be mutual, should be carefully circumscribed to just what is truly necessary. Plaintiffs should file any amended complaint that contains any claims by Trellus within 21 days, or by Tuesday, April 8, 2014. The May 19, 2014 trial date is ADJOURNED. The parties should confer on a proposed schedule from here to resolution of this matter, and include, within such schedule, any provisions for additional motions for class certification and any other motions. The parties should also inform the Court if there is any reason why the pending motions for summary judgment of the auditors cannot be decided at this time.
