Not sure it can go the other way. My understanding is the judge ruled in Blackberry's favor and told Facebook and Blackberry  to go away and negotiate a settlement, or , the judge would  do it for them. Others on this board closer to the topic can add clarification..

@Yasch22, What do you make of this statement? "resolve disputes between them, including the present action" WHEREAS the parties have reached a binding agreement in principle to resolve disputes between them, including the present action......

I'm no lawyer, but my understanding of the english language is this would encompss all current actions, not just the legal fee settlement for the FAcebook lawsuit against Blackberrry that got tossed out.  Disputes - plural. Did you her anything more on this topic.
