I could be wrong.... maybe it's TMX that's in the wrong and

BPO gave notice. I would consider BPO giving TMX notice as a "public new release" as once the TMX post such information, it's posted for all to see at the same time.

But I have the feeling this is not so, TMX still waiting most likely.
