Inspection Officer Order VAR-JJD-001-2024 issued to Trans Mountain

March 19, 2024

On March 12, CER Inspection Officers and TMX-IAMC Indigenous Monitors conducted an unannounced inspection on spread 6 of the Trans Mountain Expansion Pipeline near Lightning Rock (Abbotsford, BC). They observed company contractors working without authorizations and mitigation plans required to work near a known and active nesting site of a Red-tailed Hawk.

Inspection Officers have issued an Inspection Officer Order requiring the company to stop all reclamation and clean-up activities until the Inspection Officer is satisfied that the potentially hazardous or detrimental situation has been remedied.

The company must also:

  • correct and provide documented evidence of all rectified non-compliances for this section of the pipeline right of way before they can return to work
  • conduct an internal investigation to determine the root cause of this incident for CER review
  • confirming how Trans Mountain will oversee the scheduling and coordination of its contractor work crews going forward
  • Submit to the CER a commitment from the Accountable Officer that all corrective actions will be implemented as described.

We will continue to follow up with the company to ensure it complies with the Inspection Officer Order. Once the company sufficiently addresses the requirements list above, the order will be lifted.

Absolute BS.. these inspectors are just creating jobs for themselves.. what a waste of time and money.. the narrow ROW that exists for this P/L is NOT crucial to any species, let alone a bird that can fly a mile away from it to nest in the matter of 30 seconds.. what a gong show these goofs have become..!!    Nature is NOT THAT FRAGILE..!!! The birds will adjust to it..!!!

jleer42 - you must remember that nobody knows the sanctity of birds like the First Nations People! When you see all of their Headresses made of Eagle feathers - ever wonder where they come from? They are humanely netted and a few feathers are plucked. Then the eagles are released unharmed to live, breed and nest happily ever after!  : ) mugs

True, but I think there is a rational solution which does not involve stopping all activites. They could protect the hawks without a full shut down of activites They stopped the TMX construction due to humming birds for 4 months in 2021, frogs in 2023. I just don't see the balance, to many choices seem to be irrational. We as humans impact our environment, we can't stop all our activities ...more

Yeah, I'm guessing mugs was being sarcastic. Aren't we're talking about red tail hawks anyway? Not eagles? According to the Canadian encyclopedia (anyone have one?) the most common hawk in Canada , by the way, is the red tail. A beautiful bird I've never seen at the dump, on road kill, or scavenging heaps of rotting salmon, where eagle feathers are most likely "collected" ...more

This has nothing to do with production flowing threw this line.Reclamation and clean-up may takes yrs depending on how much Inspector & contractor want to keep plucking the tax payers! Been a open check book for anyone involved!!
