the letter is now out open with any Google search - go read it. After a long winded blurb about himself, he leans into one of his bigger assertions. He actually has the st@pidity to try and get the OSC to consider that there are obviously accounting disclosure issues because CXR has had 2 audit firms and 2 CFO's in short time period. He says all that to them when he knows d@m well that they switched from a mid-tier firm to a big 4. He also knows that the Sept financing group would have made a Big 4 firm a necessary condition of the financing. ......what amazes me is that he thinks the OSC won't understand the reasoning behind the audit and CFO replacements and instead will act on his selectively sliced mis-information. It is insulting to the OSC to treat them with such fallacious arguments. Does that idi0t really expect the OSC to act on such half information?

Puma,  yes read it yesterday.  Cohodes reasoning is that since MT and his new Cfo were part of biovail which had accounting issues then there has to be accounting issues with Cxr.  I guess his theory is that people don't change and the past repeats.  By this  very reasoning, and since cohodes went bust in 2008, I expect him to go bust again this time around.  I ...more

I read that fine piece of literature again and I think an even better example of how completely st@pid this guy is comes from the fine notion that when writing to the OSC, itself a quasi-court of Ontario, he is so dummmm as to imply that MT only filed this in the Ontario Court of Justice because a real court in the USA would never have accepted to claim in the first place. .... If anything it is Cohoges and his group of buddy shorts that should be investigated by the OSC and IIROC and SEC for stock manipulation and running a series of attcks against the company, imo.

my guess is that during discovery marc will be requested of documentation on how he profited from defamation including co-conspirators and any aliases he may hold including here. In that they may find additional examples of defamation. In the end, there may be codefendants.

Burden of proof is actually on Thompson to show how his reputation was damaged by Cohodes's remarks, since he initiated the lawsuit. Cohodes is the defendant and as such benefits of the presumption of innocence. I'm telling you, no details will come to light and it will end in a settle.

cn, you should read up on civil law process. MT can use subpoena to access any data needed. Second, there is no presumption of innocence. It is the law of probability. 51% is enough to win a civil suit.

What are babbling about ? There is always a presumption of innocence in any suit, civil or criminal. Thompson is accusing Cohodes of having damaged is reputation, he thus has to prove how this damage was done. You think he can just say ''Hey I'm hurt I want $3 million'' and it's a done deal ? Lol. Probability has nothing to do with it. Besides, a subpoena isn't issued ...more

Lattice - With all due respect which equals zero in your case, I do not believe any of your defenses will work when you call someone an outright fraud without any reservations. I see this as an open and shut case for MT as the onus would be ob Cohodes to prove MT is a fraud in every respect, not just on some of his actions or comments. MC should know better than to make such an outlandish comments ...more

Correction: That last sentence should read -  I think the rest of us longs and CXR should sue MC and buddy shorts for damages of collusion to damage the reputation AND SP of the company in an unlawful manner.

Why delete any tweets if you did nothing wrong.  Anyway I'm pretty sure the court in Ontario will be very leaniant on you mr cohodes since you are such a huge basher of anything Canadian.  From following this cohodes for the last four months I thought he was a racist pig towards the Chinese but trust me he is more racist against Canadians in general.   Our courts are going to ...more

I am not short/ but I did read the Open Letter and it is very clear what the man who is being sued is saying.  He put it down very clearly in the long letter.  And I don't like the stock price but I thought the letter was very good and looked like it was written by a lawyer.  Also we don't get any information from CEO just that his "reputation was damaged and his ...more

No Thompson remains quiet as ever and leaves the shareholders guessing with the rest of the world. There was a time, when the shorts were the loudest, in which I appreciated that he said nothing. Anything that he said could have been distorted by the shorts. But, in hindsight, staying silent like he is makes the shorts just that more powerful. Things just like to come in threes. Responding to Steve911 I decided to briefly double check the chicken letter. Now the lawsuit is for comments chicken man made about tarring MT as a fraud becuase he was in a company that had fraud. Who cares that MT was never charged or even disciplined by the UC law society.
