Could it be

that this is a personal suit (vs company sponsored) because he will soon be no longer an employee?  Just speculating.

CXR board certainly has an obligation to look at ending MT's leadership simply on preformance alone. This just adds one more reason to get rid of him, as I believe the board is under more pressure to do something than MT.  Also, the short crew will also want to create some separation from Cohodes. Lattice referred to speona's on CXR. It works both ways.

Yeah anything is possible but don't forget he is CEO, Chairman, and a Director. He has a lot of weight on how things are decided by the board. So, if it's about him getting out, it could come from someone else than the board ( institutional investors pressuring ) but I sincerely doubt it to be the case. It's odd though that the lawsuit comes now, so long after the comments were made.

When a company is in a phase of strategic alternatives, they try to end all legal proceedings not add more. This is also why the management has not been buying any shares. There is currently a blackout due to ongoing discussions.

In the next CC, I absolutely want someone to ask the management why they didn't buy any shares in the last 6 months or so. Curious to hear their answer and also if there's any validity in it.
