If this dumps into the low .50s as the S&P does a double bottom at 3600, I think it would be a good flip into Christmas. Otherwise the grind continues.

Exro could be a great trade, but they've got that pesky lawsuit hanging over them. It's the whole 'Dynamic Torque Switching' trademark infringement, and patent infringement thing that just won't go away. ePropelled is going to ride this hard in my opinion, and it's anyone's guess on how it's going to land. If the lawsuit had any merrit they would have petitioned the courts to have them stop manufacturing the coils by now. The problem Exro has is that they are burning cash, and cash is getting more expensive not to mention the cash they are spending right now is being killed by inflation. But a bounce is a bounce, look at the one off of the $1.00 mark as the market also bounced. I wouldn't park ...more

If the lawsuit didn't have merit, the court wouldn't be waisting everyone's time and money. 'Dynamic Torque Switching' is a registered trademark of ePropelled's. That's part of their statement of claim that worries me. That's why I'm waiting on the sidelines for any sign that the litigation is spurious or valid. Not sure exactly what patent is in dispute. Exro has 6 existing and 1 pending on the USPTO website. I believe someone suggested it is the latest one 11081996 approved August 3, 2021. They have others dating back to 2006. ePropelled has one dated in 2007. They also have one pending from 2021 and one pending from 2022. Just to note -- the 2021 ePropelled application/publication is at a rejection stage -- which means the examiner does not accept it in it's existing state. The Company now has 90 days for revisions. The 2022 has been accepted for review and publication so an examiner will be assigned to review the paperwork. The 2022 application = Assignment abstract of title for Application 17613036  ...more

Thanks for the info Pandora. I had a look at ePropelled's claim again, and it looks like their patent in the claim that they feel is being infringed on is # 7382103. That, and the 'Dynamic Torque Switching' TM, are from my assessment, the basis of the suit. I think exro needs to get this out of the way before the stock can come back to life. It's a filed suit, the court has no choice but to hear it out. This is simply a ploy to hold up Exro's progress. It's priced in and won't have any effect on the SP till it goes to court and that could be a long time from now with Covid delays and eProppled knows that.

Conversely, if the lawsuit has no merit whatsoever, I suspect EXRO would've filed a motion by now to have the case thrown out....? Also, correct me if I'm wrong, but EXRO is currently not selling any products containing the disputed technology, so there's no sales or profits to "stop" as the products are still in development and/or being tested. In response to claims made by ePropelled, Exro has filed a petition with the U.S. Patent and Trademark Office for review of ePropelled's patent.   Exro asserts that the patent which ePropelled claims it has infringed is invalid.   Exro also submitted an in-depth independent analysis of the patent by award-winning MIT Professor. I agree. If exro loses the suit, there is the possibility they could license the technology from ePropelled. As mentioned in a previous post, I've seen that before. AJX is one such company. They're no longer listed, as they were bought out. They were in the Ag space. I hope they keep the lights on, as I'd like to see them succeed.
