Remaining question

We still don't know if the unnamed suitor disclosed back in August is the same Stephen Smith that has made this deal at $44. 

I suspect it is not, because HCG specifically negotiated a 'go-shop' provision in this deal. That's a bit unusual, and suggests the company felt there was still a possibility of another bidder.
