You show an ambulance to an Ambulance Chaser, and they will chase it...  some law firms make a living out of it doesn't mean there is anything there are a "win-able case" but the law firm will be more than happy to take money from folks to waste the court's time.
 
The deal between Tilray and HEXO was negotiated and you can be assured that both sides seen it as the best case scenario / outcome for a win-win between the companies given the state of the Cannabis Sector at this particular time. 
 
Going forward the new company will be larger and leaner.
