Canopy Growth sues GW Pharma for CO2 Extraction

Every cannabis company that performs extraction absolutely needs to read this article. If anybody is to use the word "disruptive" (hopefully one final time) in the extraction industry this is it.

Canopy bought the original CO2 patent, from 2000, on Tuesday for the process of extracting CBD and THC  from plant material and filed the lawsuit the same day in Texas.
If Canopy wins or GW Pharma settles it means everybody in the CO2 extraction is fair game.

Canopy will fail. Since the technology has been around since the mid-1980s Canopy's 2000 patent is worthless as it was obvious in 2000 that Supercritical Fluid Extraction could be applied to hemp and cannabis. Good thing Canopy only paid $1.00 for it.   For GW Pharmaceuticals to win, the company will have to demonstrate that its method, described in broad terms on its website, uses ...more

I have to totally disagree with you stating that it will fail for three reasons: 1.  Canopy would not waste their time and money if it was so obvious (in your opinion) that it is going to fail.      Lawyers and court filings are not an inexpensive endeavour costing at least $10,000's to millions of                 dollars.This ...more

1. GW Pharma was aware of this patent for many years. They would not willing infringe this patent if they thought it was valid. 2. Granted patents are challenged all the time. Patent clerks are low paid government workers and don't have legal skills.

3. The trouble with patents is they disclose the secret sauce allowing others to tweet the formula to avoid infringement. How in the hell can Canopy know what goes on inside a secure GW Pharma facility?
