There is no appropriation.  As well, any expropriation compensation would be based on economic value for which there has and is no demonstration.    Additionally, the proponent can reapply for a 404 permit and associated process.   This avenue is still available.   They should have applied for underground mining the east zone, but given grade distribution and economics
