In the end ndm will just sue the US government for damages with cause. Ndm bought the land that was zoned for mining. Dotted every I and crossed ever t - spent billions of $ and the US government never intended to grant the permit - slam dunk

Sorry no "takings" compensation.  State Land.  Potential federal withdrawal within regulations.  No proven/probable reserve established/released.  If your hope is for government compensation, its over.  Pennies on dimes, if that. Underground mine the resource, easy.
