So If all these new arguments now raised in this article are purportedly correct and legal, how come the EPA with their open-ended budget for cases didn't raise them in the first place? Aren't they experts? Haven't they been on this case for years? Didn't they disclose that any such Tailing pond leak was highly unlikely? Based on old tech making it even less likely?

With each extension comes more raised Judicial eyebrows. How many more extensions will be granted? Time is running short. One thing all this wrangling does is substantiates the State of Alaska's rationale for going direct to SCOTUS for infringement on state's rights. So I bet the case is accepted. Incorrect new misinformed account. The USACE can do nothing until SCOTUS concludes their review IF they will even consider reviewing Alaska's motion. Irrespective of any outcome: 22-years. 1 billion spent. No Feasibility Study releasing proven/probable reserves, no value established, no permits(+60 required) prior to Alaska legislative vote, no financing, incorrect mine plan, no interest ...more

Throwing spaghetti at the wall? Do you think Anglo Ashanti (one of the world's largest major miners) was unaware of the process ? ( i.e. order in which necessary steps needed to be taken? They were involved until politics against the mine rendered their efforts best directed elsewhere. The new paradigm of resource inflation has reopened interest. SCOTUS doesn't issue permits.  The USACE issues ONE PERMIT of consequence; a 404 permit which cannot be issued under EPA veto or any time soon IF EPA's veto is someone recinded.   The project requires +60 permits and authorizations prior to Alaska legislative vote.  ZERO issued to date.  Current mine plan uneconomic. Go Granny go, but Granny don't know. Incorrect. They have never been stopped from permitting. A new Operating/Mine Plan (POO) can be submitted to the USACE at any time based from the new PRELIMINARY ECONOMIC ASSESSMENT (PEA).  They could also submit all their Local and State permit applications.  Point being your statement in context of regulatory permitting is inadequate.
