What the Chevron decision doesn’t mean.

EPA’s Pebble veto is based on EXISTING LAW and 13 similar vetoes regarding 13 different projects are derived from EXISTING LAW.

All of EPA's veto efforts have been successful. All 13 previous vetoes stood the test in courts.

The SCOTUS Chevron ruling is different, it's not based from EXISTING LAW.

Nice attempt at bait and switch. The EPA was over-zealous and wontonly capricious in short cucuiting the ACoE's process. This is exactly the kind of requiring the remedy The Court envisioned. Beside that, there is legislation moving through Congress that would confirm this stripping of self-proclaimed power by unelected bureaucrats. That is not how it works. When the Supreme Court strikes down or weakens a law, it is effectively changed.

What RC doesn't seem to understand is SCOTUS is stopping illegal actions not covered by existing law. Dumb.
