Defendants request that the pending disposition of their appeal of the order dismissing their motions to strike the statement of claim, (alternatively for particulars), they not be required to file a statement of defence or otherwise take any step to advance the proceeding. Not too sure! There were a few litigations in the past with the order version of this patent against LG, Ericsson and others with no obvious and mixed success. I thought the Apple vs WiLan suit was all settled a couple or 3 years ago? Or is this just the part where the big U.S. company drags it out for many years.
