Fear Not Of Clearwater

The reason that the bondholders power was limited in the reorganization was because of the Cuban veto.  The same veto would make it difficult for any shareholder group to make a successful hostile bid  for the Company.

Rather, I believe the Clearwater investment is based on the very thing that has been their bread and butter for years - namely the purchase of cheap stocks in the midst of a turnaround.

Oh what, so now you're a lawyer.  It is a significant obstacle to anyone attempting a hostile takeover - in essence a veto right. Read on......... Unlike Canada which blocks any takeover "contrary to the national interest". Ditto for EU , Australia, and other "not communist" countries.

It seems in this case you are acting as the lawyer. Anyone with any basic legal experience would realize that's not a veto.
