This is a very bizarre situation I wonder what that does for other tailings ponds when the mines were closed and reopened at a later date for reclaiming tailings or restarting under a new ownership? All it means is that Coles et al did not do adequate due diligence risk assessment for this part of the project.

Ridge, I am pretty sure the decision will be overturned. definition from Mineral Titles mineral: means an ore of metal, or a natural substance that can be mined, that is in the place or position in which it was originally formed or deposited or is in talus rock mineral tenure / lease - means a claim to the minerals within an area which has been located or acquired by a method set out ...more

I'm sure Ske will win the ownership of what has been deposited in the pond but at a cost. The guy causing the issue looks tuff and is likly looking for some kind of payout for doing nothing but having an old claim someone missed in all the details. Sort of like a bad tennant that won't pay the rent and eviction does not come without some pain to remove.

Seveneleven, A valid sentiment - but I seem to recall that the claim was allowed to lapse under Barrick's watch.  If you find out differently, let us know - but I think that I am correct in this. Makes some sense - with a closed mine...but on-going maintenance costs...who wouldn't want to reduce the ongoing costs?  Particularly if Barrick knew that it was "dead-rock" ...more

Great posts, no doubt Ske is taking action. However this guy is Bad News. A guy with a right to resources. Perhaps never done well by Barrick and Skeena?Google the name. This guy has noting to loose.
