Even if SVB prevails in court, how can they enforce a judgement against a sovereign country?        This is a very looong process with no return on the investment.

How do courts in the U.S. enforce judgements?  They seize assets.  Then, Mexico can protest any seizures, however, as a party to NAFTA having just lost an arbitration case involving violation of NAFTA agreements they will have no leg to stand upon if they want to attempt to reverse any seizures. This is a very long process and very far away from a slam dunk case. The damages are ludicrous and will surely be appealed. It would have been much better to develop the mine but this blockade speaks loudly of mismanagement of community relations when you cannot make an agreement with a $100 million option on the table.

What appeal, its arbritation?. For an example, look at Windshear Gold who used the same superstar lawyers to arb against Tanzania - they lost another case, then settled with Windshear. Of all places you'd think would blow off paying, its Tanzania, but they did. One of their airlines was repossed in Europe after another case. With NAFTA, its even better. Yes, it bodes well for us that we received an advance from the law group handling the case, money talks as they say. The questions that remain for those of us still hanging around are: 1) How long until the case is settled? 2) How many millions of dollars will the settlement be? 3) What will SVB management do with the funds?  A one time dividend and then close up shop or attempt to parlay ...more
