The class action suits are usually based on losses that occurred between two dates. There is the date of the crisis that caused the downfall, and some agreed upon date thereafter, where most of the losses had occurred. So doubtful that a higher price at court time is going to make any difference to the civil lawsuit. The losses will be documented and very easy to recognize.
