Litigation is expensive
I'm not sure they have the resources to expend on a lawsuit which would be hotly contesed and very protracted. One assumes that their shareholders would question such a move too, although there doesn't seem to be much concern for shareholders, (which is why they lost!).
A sound business move would be to either accept the status quo and try another time, which would put management under pressure to perform, or get out now and eat their losses, knowing that a large dump would sink the current SP and increase their loss. Trying to reverse the AGM result is definitely unsound!
